By accessing or using this website (the “Website”), you agree to these Terms and Conditions (“Terms”), our Privacy Policy, and any other rules and policies we may publish from time to time.

About becam.art

becam.art is an online platform showcasing contemporary artists, artworks, curatorial initiatives, and art-related legal consultation services.
becam.art offers a space where visitors can discover and purchase original artworks by selected artists. These works may be featured on our Website, related platforms, and associated social media channels. Browsing the Website is free of charge, and visitors are welcome to explore the collection without any obligation to make a purchase.
becam.art acts as an intermediary between artists and buyers. Unless stated otherwise, it is not the seller or reseller of the artworks displayed on the Website.


Use of the Website

You agree to use the Website:
• lawfully and in good faith;
• in compliance with applicable EU and international laws;
• without infringing the rights of artists, the gallery, or third parties.
You may not:
• reproduce, distribute, modify, or commercially exploit any content without prior written consent;
• use artworks or images for AI training, NFTs, or other derivative digital uses without explicit authorization;
• attempt to interfere with the Website’s security or functionality.


Intellectual Property Rights

All content on the Website - including artworks, images, photo, texts, design, branding, and logos - is protected under copyright law and international treaties.
Copyright and moral rights in artworks remain with the respective artists unless expressly transferred by written agreement.
The purchase of a physical artwork does not transfer copyright or any other intellectual property rights in the artwork. Title to the physical artwork passes upon full payment, while all copyright and other intellectual property rights remain with the artist unless otherwise agreed in writing.
Any reproduction or public use requires prior written permission.
We respect authors’ moral rights, including the right to attribution and integrity of the work.


Artwork Information & Sales

Where artworks are offered for sale:
• Listings constitute an invitation to treat, not a binding offer.
• A purchase is subject to confirmation.
• Prices for Artworks will be as specified on the applicable listing and may be subject to VAT in accordance with tax regulations.You are responsible for complying with all obligations under applicable law regarding the collection and payment of any taxes, including VAT where applicable
• Shipping costs, customs duties, and import taxes (if applicable) are borne by the buyer unless agreed otherwise.


Delivery and Receipt

The artwork will be considered delivered once delivery is confirmed by the carrier. If no tracking information is available, delivery will be assumed 30 days after payment unless the Buyer informs becam.art that the artwork has not arrived.
As the artwork is shipped directly by the Artist, any delivery issue should be reported to becam.art as soon as reasonably possible so that the matter can be reviewed with the Artist and the carrier. If no proof of delivery can be provided, the shipment may be treated as undelivered and an appropriate solution, including a refund where applicable, may be arranged.
Upon arrival, the buyer should inspect the package and promptly report any visible damage or issue to the carrier.
If, upon inspection, the buyer finds that the artwork does not conform to the order or has arrived damaged, the buyer must notify the becam.art in writing by email at kamila@becam.art within 14 days of receiving the artwork.
Any questions, concerns, or claims relating to an order should be submitted to the becam.art at kamila@becam.art, and we will work with the buyer and, where applicable, the relevant artist to review and address the matter.
To process an order, becam.art may request certain personal, payment, and delivery information from you and may share such information with third parties where necessary for payment processing, fulfilment, delivery, or other order-related services, in accordance with our Privacy Policy. By placing an order, you confirm that you are legally entitled to use the payment method provided, including any bank card or other means of payment.
In accordance with EU consumer protection law, certain buyers may have statutory withdrawal rights, except where exemptions apply (e.g., commissioned or customised works).
We reserve the right to accept, decline, or cancel any order or request for services, including where information, pricing, or descriptions were incorrect. If a payment has already been made for a cancelled order, the relevant amount will be refunded.


Certificate of Authenticity

A certificate of authenticity from the Artist will be included with the purchased artwork.


Colour Representation

We make reasonable efforts to present the colours of the artworks on the Website as accurately as possible. However, the way colours appear may vary depending on a visitor’s screen, monitor settings, or device. For this reason, we cannot guarantee that the colours shown on the Website will exactly match the actual colours of the artwork, and we accept no liability for such differences.


Art and Law

The Website may contain information about the intellectual property law consultation services offered by the becam.art. This content is for general information only and should not be understood as legal advice. A lawyer-client relationship is established only through a separate written agreement. Any consultation services are provided under a separate engagement agreement. In some cases, the becam.art may choose to provide services on a pro bono basis.


Limitation of Liability

To the extent permitted by applicable law, becam.art shall not be liable for any indirect, incidental, or consequential loss arising from the use of, or inability to use, the Website, minor inaccuracies in the display of artworks caused by screen or device settings, or the acts or omissions of third parties beyond its reasonable control. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.


Changes to the Terms and to the Services

We may update these Terms, change the Website or Services, or suspend or discontinue them at any time. Any updated Terms will be published on the Website, and by continuing to use the Services, you accept those changes.
We may update these Terms and change, suspend, or discontinue any part of the Website or Services at any time without prior notice. This includes artworks, prices, descriptions, artist profiles, legal services, publications, and other website content. We may also correct errors, inaccuracies, or omissions and update information on the Website when needed.
